Dale Parker, Gordon Oldham and Kristine Rowsey defended a 4 day trial on an admitted liability rear end auto accident case. The Plaintiff underwent injections and neck surgery, incurred $129,000 in past medical bills and had future medical bills and lost earning capacity claims totaling $600,000. Plaintiff’s surgeon, pain management doctor and chiropractor all testified and related the injuries and treatment to the accident in question. The plaintiff had no real prior problems. Our team was able to attack the plaintiff’s credibility and the financial relationship between the plaintiff, her lawyers and the treating doctors. Plaintiff’s counsel asked the jury to award $1,211,000 – $3,210,000 on our $100,000 BI policy. After only 50 minutes, the jury sided with the defense team finding that the plaintiff’s lawyers did not meet their burden of proof and therefore our client’s negligence was not the legal cause of any damages.
