Brock Johnson and Matthew Easterwood Obtain Outright Defense Verdict
June 26, 2014Brock Johnson and Matthew Easterwood just obtained an outright defense verdict in a 3-day trial in Hillsborough County. The Plaintiff, a pedestrian, claimed that he was struck by the Defendant’s vehicle in a Wal-Mart parking lot as the Defendant turned down a parking lane. The Plaintiff claimed nearly $50,000 in past medical expenses and asked for significant future damages.
The defense claimed that the Plaintiff was not paying attention and merely walked into the side of the Defendant’s vehicle, causing the impact. The defense further claimed that the accident did not cause any of the Plaintiff’s injuries, as he had a significant prior history of similar complaints and treatments.
After less than an hour of deliberation, the jury returned a defense verdict on the issue of liability and causation.
