Roland Hermida and Brock Johnson recently completed a three day trial in an admitted liability auto case. The defense admitted causation as to some of the Plaintiff’s claimed injuries, however, defended the case on the reasonableness and necessity of the Plaintiff’s continued medical treatment and bills.
The property damage to both vehicles was moderate, and the Plaintiff treated consistently for years afterwards for low back complaints. There were no documented previous back complaints. Past medical expenses were over $26,000.
The jury awarded no future treatment, found no permanent injury and awarded past medicals of only $15,000, which will likely result in a net zero verdict after setoffs and recovery under a proposal for settlement.
