Mike Rabinowitz and Carlo Marichal recently obtained a defense final summary judgment in two different cases involving very similar facts.
The cases involved two different cars that ran into a bull roaming loose on Highway 27 resulting in serious personal injuries. The plaintiffs sued the bull’s owner under the Warren Act. Mike and Carlo moved for summary judgment, arguing that there was no evidence of how the bull escaped the fenced enclosure and, therefor, no evidence of negligence.
The judge agreed with the defense and entered defense summary judgments in both cases.
